Terms of Use — detoxify

Welcome to detoxify. These Terms of Use ("Terms") govern your access to and use of the detoxify mobile application for iOS ("App"), operated by detoxify ("Company", "we", "us", or "our"). By downloading, installing, registering for, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

• By accessing or using the App, you agree to be bound by these Terms, our Privacy Policy (available at https://detoxify.forvibe.app), and any additional terms, policies, or guidelines we post within the App.
• You represent and warrant that you have the legal capacity to enter into these Terms. If you are using the App on behalf of an entity, you represent and warrant that you have authority to bind that entity.
• These Terms form a binding agreement between you and the Company.

2. Description of Service

• detoxify is a health and addiction-recovery application that provides users with tools to track and manage addictive behaviors and build healthy habits. Key features include:
  • Multi-addiction tracking and real-time dashboards showing sobriety streaks and financial savings.
  • An urge logger to capture triggers and intensity of urges.
  • Daily challenges designed to build resilience.
  • A health timeline that visualizes physical recovery milestones.
  • Cinematic onboarding, biometric security, badges, level-ups, and gamified progress visualization.
• The App is provided on a freemium model: basic features are free; additional features are available through paid subscriptions.
• The App integrates with certain third-party services and iOS frameworks (see Section 7 and Third-Party Services below).

3. User Accounts & Registration

• Account creation: To access certain features you must create an account and provide accurate, complete, and up-to-date information (including a valid email address).
• Authentication and security:
  • You may secure your account using local biometric authentication (via Apple’s LocalAuthentication) and device-level security features.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • Notify us immediately at detoxify@forvibe.app if you suspect unauthorized use of your account.
• Age restriction: The App is not directed at children. You must be at least 18 years old to use the App. By registering, you represent that you meet this age requirement.
• Account deletion: You may delete your account via the App or by contacting us. Certain information may remain in backups or records for legal or business purposes as described in our Privacy Policy.

4. User Obligations & Acceptable Use

• You agree to use the App only for lawful purposes and in a manner consistent with these Terms.
• Prohibited conduct includes, but is not limited to:
  • Using the App to harass, stalk, threaten, defraud, or harm any person.
  • Attempting to gain unauthorized access to the App, other accounts, or Company systems.
  • Uploading content that infringes third-party rights, is obscene, defamatory, or promotes illegal activity.
  • Reverse engineering, decompiling, or attempting to derive source code or algorithms from the App except as expressly permitted by law.
  • Interfering with or disrupting the App, servers, or networks connected to the App.
• User-generated content:
  • You are solely responsible for the content you submit (journals, urge logs, notes, images, etc.).
  • By submitting content, you grant the Company a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, distribute, prepare derivative works of, display, and perform that content in connection with the App and the business of the Company.
  • We reserve the right to remove or refuse any content at our discretion and to cooperate with law enforcement if necessary.
• Indemnification: You agree to indemnify, defend, and hold harmless the Company and its affiliates from any claims, losses, liabilities, damages, costs, and expenses arising from your violation of these Terms or your misuse of the App.

5. Intellectual Property Rights

• All rights, title, and interest in and to the App, including software, designs, text, graphics, logos, button icons, images, audio, video, and other content (collectively, "App Content"), are owned by the Company or its licensors and are protected by copyright, trademark, and other intellectual property laws.
• Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a compatible iOS device for personal, non-commercial use.
• Trademarks: "detoxify" and other Company logos and product names are trademarks of the Company. You may not use the Company’s trademarks without prior written permission.
• Third-party materials included in the App are owned by their respective owners and are used under license.

6. Disclaimers & Limitation of Liability

• No medical or professional advice:
  • detoxify is an informational and habit-tracking tool and is not a substitute for professional medical, psychological, or addiction treatment. The content, including insights, tips, or other information, is provided for general informational purposes only and does not constitute medical advice.
  • If you are experiencing a medical emergency, suicidal ideation, or are in immediate danger, you should call your local emergency number or contact a qualified professional immediately.
• No guarantee of results: We do not guarantee any specific outcomes or results from use of the App. Individual results vary.
• Warranties: THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
• Limitation of liability:
  • TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE APP, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • THE COMPANY’S AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO THE COMPANY IN THE SIX (6) MONTHS PRECEDING THE CLAIM (OR, IF NO AMOUNTS WERE PAID, ONE HUNDRED U.S. DOLLARS (USD $100)).
• Applicability: Some jurisdictions do not allow limitation or exclusion of certain liabilities; accordingly, some of the above limitations may not apply to you.

7. Subscriptions & Payments

• Freemium model: The App offers free features and paid subscriptions ("Premium") that provide additional functionality.
• Free trial:
  • We may offer free trials for Premium subscriptions. Trial durations, features, and eligibility criteria will be described in the App.
  • If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription and billing will begin.
• Billing and auto-renewal:
  • Subscriptions renew automatically at the end of each billing period unless canceled prior to the renewal date.
  • Payments and subscription management are processed via Apple’s App Store / StoreKit. By subscribing, you authorize Apple to charge your Apple ID account for subscription fees.
  • To manage or cancel your subscription, you must use the subscription management tools in your Apple device’s App Store settings. We cannot directly manage your App Store subscription billing; Apple controls refunds and billing issues.
• Pricing and taxes: Prices for subscriptions are disclosed in the App and may vary by region. You are responsible for any taxes associated with your subscription.
• Refunds: Refunds are subject to Apple’s policies. You may request a refund through Apple’s support channels; we cannot grant refunds for App Store purchases except as required by law.
• Changes to pricing: We may change subscription fees at any time. If we increase the price for a subscription, we will provide notice in the App or via the email associated with your account. Price changes will apply to renewals after notice; you may cancel to avoid the change.

Third-Party Services: The App integrates with or uses:

• LocalAuthentication (Apple) — for biometric authentication and local device security.
• UserNotifications (Apple) — to deliver local and push notifications (user-controlled).
• StoreKit (Apple) — for in-app purchases, subscriptions, and trial management.
  Your use of these services is subject to the respective third-party terms and policies. We do not control these third parties and are not responsible for their actions.

8. Termination

• Termination by you: You may stop using the App at any time and may delete your account via the App or by contacting us.
• Termination by the Company:
  • We may suspend or terminate your access to the App and/or your account immediately, without prior notice or liability, for any reason, including breach of these Terms or illegal activity.
  • Upon termination, your right to use the App ceases immediately. We may delete or retain your content and data as described in our Privacy Policy.
• Survival: Provisions that by their nature should survive termination (including Intellectual Property, Disclaimers & Limitation of Liability, Indemnification, Governing Law, and Severability) will survive termination of these Terms.

9. Governing Law

• These Terms and any dispute arising out of or related to these Terms or the App will be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflicts of law principles.
• You and the Company submit to the exclusive jurisdiction of the state and federal courts located in California for any dispute not subject to mandatory arbitration (if any). If any provision of this section is prohibited by applicable law, then this section will be deemed modified to the minimum extent necessary and the remaining provisions will remain in full force and effect.

10. Changes to Terms

• We may modify these Terms from time to time. If we make material changes, we will provide notice via the App, email, or other means prior to the effective date of the changes.
• Continued use of the App after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the App and may delete your account.

Additional Provisions

• Privacy: Your use of the App is also governed by our Privacy Policy, which explains what data we collect (including financial information and biometric-related authentication data), how we use it, and your choices regarding that data.
  • Financial information: Payment processing for subscriptions is performed by Apple (StoreKit). We may receive transaction receipts or metadata; we do not store your full payment card details.
  • Biometric data: The App may use device-based biometric authentication (via LocalAuthentication). Biometric templates are managed by your device/operating system; we do not receive or store raw biometric templates. We may process or retain metadata generated by authentication events in accordance with our Privacy Policy.
• Electronic communications: By using the App, you consent to receive electronic communications (e.g., emails, push notifications) from us. These communications satisfy any legal communication requirements.
• Export controls & compliance: You agree to comply with all applicable export and import laws and regulations. You may not use the App in a country subject to U.S. export restrictions or that you are legally prohibited from accessing.
• Severability and waiver: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force. Failure by the Company to enforce a right does not constitute a waiver of that right.
• Entire agreement: These Terms, together with our Privacy Policy and any other legal notices published by us in the App, constitute the entire agreement between you and the Company regarding the App.

By using detoxify you acknowledge that you have read, understood, and agree to be bound by these Terms.
